IRS Summons Enforcement Can Pose a Risk of Being Held in Contempt, Subject to Fine and Jail

The IRS has broad powers to summons information. If you are served with an IRS summons you must comply by furnishing the information requested, unless privileged or otherwise legally excused from production.


Failure to comply subjects the summoned individual to Court enforcement. If a United States District Judge orders enforcement of the summons, and compliance does not occur without a legal excuse, the penalty is contempt. A contempt judgment subjects the individual being held in contempt to monetary sanctions, imprisonment, or both.
